  1. SUMMARY

 

1.1 - We are committed to ensuring that the privacy of your personal information is respected and maintained at all-times. We are bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). 

 

1.2 - The Terms and Conditions outlines how we manage your personal information and how we collect, hold, use and disclose that information. 

 

1.3 - The Terms and Conditions document outlines how the terms and conditions and Returns Policy is managed and governed on the shop.mattel.com.au website.  

 

  1. DEFINITIONS

 

2.1 - These words when used in this Terms and Conditions have the following specific meanings: 

 

  • APPs — means the Australian Privacy Principles in the Privacy Act. 

 

  • Member — means an individual who has joined the shop.mattel.com.au database 

 

  • Join Date — means the date a member joins the shop.mattel.com.au database 

 

  • Participating website — means shop.mattel.com.au owned and operated in Australia by RPG Toms Pty Ltd — ACN 625 027 625 

 

  • Personal information — has the same meaning as in section 6 of the Privacy Act, which, for ease of reference, means information or an opinion about an identified individual or an individual who is reasonably identifiable: 

 

(a)    whether the information or opinion is true or not; and 

(b)    whether the information or opinion is recorded in a material form     or not, and personal information includes sensitive information. 

 

  • Privacy Act- means the Privacy Act 1988 (Cth). 

 

  • Returns — means the returns policy for customer purchases from RPG Toms Pty Ltd via shop.mattel.com.au. 
  • Rewards — means rewards or other benefits given to Members as a consequence of purchasing behaviours or incentives. 

 

  • Sensitive information — has the same meaning as in section 6 of the Privacy Act which, for ease of reference, means information or an opinion about your racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, criminal record, health information, genetic information, biometric information for automated verification or identification purposes and biometric templates. 

 

  • We, our, us or Shop Mattel Australia — means RPG Toms Pty Ltd (ACN 625 027 625) and each of its related bodies corporate. 

 

  • You or your — means authorised distributors, retail customers, service providers, contractors, job applicants (or any individual personnel of those foregoing persons) and any other individuals whose personal information we may collect, disclose, use or otherwise handle. 

 

 

3.0 — GENERAL 

 

3.1 — Dealing with us anonymously 

 

You have the option of not identifying yourself or using a pseudonym when dealing with us unless we are required by law or a court or tribunal to deal with individuals who have identified themselves or it is impractical for us to deal with you if you have not identified yourself. However, if you do so, you may not be able to access, or use, all or part of our goods and services. 

 

3.2 — Direct marketing 

 

From time to time we may use your personal information to provide you with marketing materials in relation to offers, specials, products and services that we have available. We will not collect, use or disclose your sensitive information for the purpose of direct marketing without your written consent. You may opt out of receiving marketing communications from us at any time by following opt out/unsubscribe instructions provided in such marketing communications. 

 

3.3 Accuracy of your personal information 

 

While we will endeavour to ensure that the personal information collected from you is up to date, accurate and complete, we will assume that any personal information provided by you is free from errors and omissions. You may request that we update or vary personal information that we hold about you using the contact details set out below. In some circumstances where we correct a record, we may still require the retention of the original record. 

 

3.4 — Requesting access to your personal information 

 

You may obtain access to personal information which we hold about you by contacting us using the contact details set out below. When you request copies of your personal information held by us, we will endeavour to provide you with such personal information as soon as reasonably practicable, provided however that there may be occasions when access to personal information we hold about you is denied. Such occasions would include where release of the information would have an unreasonable impact on the privacy of others. If we refuse to provide you with access to or correct your personal information, we will provide you with an explanation in writing. 

We may require you to verify your identity and specify what information you require. We will give you reasons if we deny access. 

We ask that requests for access to personal information be made in writing. Photo identification may be required. A fee will not apply to making a request for access to your personal information. A fee may apply and be charged to cover our costs in collating, copying and providing certain information to you. 

 

3.5 — Making a complaint about a breach of your privacy rights 

 

If you are of the view we have breached the APPs, the Privacy Act, or any related privacy code in dealing with your personal information, you may make a complaint by writing to us using the contact details set out below and we will endeavour to provide you with confirmation as to how we propose to deal with the complaint as soon as reasonably practicable.

3.6 — Changes to our Terms and Conditions 

 

We reserve the right to change this policy at any time. The updated policy will be available on this website www.retailprodigygroup.com. 

 

3.7 — The Terms and Conditions may be modified at any time without prior notification by Retail Prodigy Group. Any changes or modifications to the Terms and Conditions may be applied retrospectively. 

 

4.0 — SALES AND DELIVERY 

 

4.1 — All payments need to be made in full before any goods are dispatched 

4.2 - When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card. 

 

4.3 — We reserve the right to extend, cancel or change any promotional offer, discount or coupon at any time. 

 

4.4 — We will supply the goods as shown on www.shop.mattel.com.au following confirmation of your order. 

 

4.5 — We will use our best endeavours to meet delivery timeframes but cannot guarantee delivery timeframes will be met. 

 

4.6 — In the event we cannot fulfil your order we will provide a full refund. 

 

4.7 — Only credit card, PayPal, AfterPay and ZipPay payments options are currently available on www.shop.mattel.com.au 

 

4.8 - Standard delivery to Australian addresses is $10.00 at the expense of the customer. Estimated Shipping time is 3-7 business days. Standard delivery to New Zealand addresses is $20.00 at the expense of the customer. Estimated Shipping time is 7-21 business days. 

 

4.9 - Express delivery to Australian addresses is $15.00 at the expense of the customer. Estimated shipping time is 1-3 business days. Express delivery is not currently available to New Zealand addresses.

 

4.10 - Orders over $100.00 Australian Dollars will be eligible for free standard shipping to Australian addresses (collector and bulky items excluded)

 

4.10a - Orders including Collector products are considered fragile and will incur an additional delivery charge to ensure the goods are delivered with additional protection to prevent damage. Collector delivery in Australia is $15 for orders under $100 and $5 for orders over $100. Collector delivery in New Zealand is $30.
 
4.10b - Orders including Bulky items require special delivery and will incur an additional delivery charge to ensure appropriate delivery of the goods. Bulky delivery in Australia is $20. Bulky delivery in New Zealand is $40.

 

4.11 - Prices for our products and shipping are subject to change without notice.

4.13 - Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though shop.mattel.com.au. The conditions of use relating to any discount code will be specified at the time of issue. 

 

4.14 Gift cards may be physical gift cards or digital gift cards that are sent in an email. Gift cards are issued Australian Dollars and are redeemable on shop.mattel.com.au. Digital gift cards will be issued within 24 hours or on a future date of your choice. They are not redeemable for cash or travellers cheques. No change will be given for a purchase made with a gift card. The gift card expires three years from the date of issue (or date of purchase for E-Gift Cards). Gift cards are partially redeemable and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the cardholder will be required to make up the difference with an alternate form of payment. Please note, Gift Cards are unavailable for use for online orders processed with Afterpay, PayPal, Alipay or Apple Pay. Gift Cards should be treated like cash. Shop Mattel Australia disclaims all responsibility for lost or stolen cards. 

 

5.0 Pricing and Availability 

 

5.1 - Whilst we try and ensure that all details, descriptions and prices which appear on Shop Mattel Australia are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.  

 

5.2 - Where applicable, prices are inclusive of GST.  

 

5.3 - Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'. 

 

5.4 - The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.  

 

5.5 - We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. 

 

5.6 - All prices listed are in Australian Dollars (AUD) unless otherwise stated. This includes shipping fees and gift cards.

 

 

6.0 — RETURNS 

 

6.1 — We will provide an exchange, credit note or refund in the situation that a product is deemed faulty. 

 

6.2 — Proof of purchase from Retail Prodigy Group is required for all exchanges, credit notes and refunds. 

 

6.3 — If an item was discounted at the time of purchase and a refund is issued then the amount returned will be the discounted amount. 

 

6.4 — If an item is returned then it will be returned to the same tender. 

 

6.5 — If there is no proof of purchase then only a credit-note or exchange option will be available and will be at the managers discretion. 

 

6.6 — To return product customers will need to send an email to shopmattel@retailprodigygroup.com and we will respond as soon as possible with instructions on the return process. 

 

6.7 — Due to hygiene reasons we are unable to accept returns for clothing purchases if it is for change of mind or incorrect size. 

 

6.8 — If a product is purchased online at shop.mattel.com.au, customers can return or exchange product only via shop.mattel.com.au. 

 

6.9 — If a customer has purchased a product online and need support with a return, please contact shopmattel@retailprodigygroup.com and Customer Support will respond with guidance.  

 

6.10 — If a purchase requires a refund after being purchased using a Buy Now Pay Later payment option; PayPal Afterpay and Zip Pay, you will need to complete the Retail Prodigy Group returns process as normal and payment refunds will be subject to the individual payment merchant’s policy. 

 

6.11 – Customers can return their order for change of mind if the product if unused and in its original packaging. (This excludes Collector items, please refer 6.15). All returns to the warehouse due to change of mind are the responsibility of the customer. Retail Prodigy Group are unable to provide compensation for postage costs for products returned due to change of mind.

 

6.12 – Retail Prodigy Group are unable to facilitate exchanges for wallpaper and any clothing purchased on shop.mattel.com.au due to change of mind or incorrect sizing.   

 

6.13 – If a customer receives the wrong product, they should send an email to shopmattel@retailprodigygroup.com. Customer Support with respond as soon as possible to your query. 

 

6.14 - Depending on the size/condition of the product, alternative return conditions may apply to orders that are delivered to New Zealand. Please contact us for more information.

 

6.15 – Customers are unable to return Collector items after 30 days from delivery date for any reason other than manufacturing faults.

 

7.0 Links from other Websites 

 

7.1 - If we link to other websites, we take no responsibility for the content of, and make no representations as to the accuracy of any third-party websites we may link to from shop.mattel.com.au. 

 

8.0 Indemnity 

 

8.1 - You agree to indemnify, defend and hold harmless Shop Mattel Australia, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this website or your breach of the Terms of Service. 

 

9.0 Terms of Sale 

 

9.1 - By placing an order, you are offering to purchase a product on and subject to the above terms and conditions. All orders are subject to availability and confirmation of the order price. Terms and conditions subject to change without notice.
